EXECUTION OF WILL

Mrs X is 80years old women , her husband was expired. She has 2 Son and 7 married daughter,  She is now staying with two sons and they take care of her very well.she has one land property in her name, now she wants to make will in favour of only two son,

kindly tell me

1. Is it a valid will and is it necessary to mentioned the daughters details in will.

2. Is it necessary t take any objection from daughters as they all reside far way from the place where she reside.

3. is it necessary to make it registered or simply Notary is enough.

1. Is it a valid will and is it necessary to mentioned the daughters details in will.

Ans. Since the property is self acquired property of the lady she can wil it to anyone of her choice. It is better to mention that the entire property will go to her sons only and the daughters have no claim or cannot claim share after she passes away.

2. Is it necessary t take any objection from daughters as they all reside far way from the place where she reside.

Ans. Not required

3. is it necessary to make it registered or simply Notary is enough.
 

Ans. It is advisable to register the will.
