Tribunals are established by law (as are courts)

- Tribunals are specialist bodies while ombudsmen are generalist

- Tribunals are "courts plus" (Lord Neuberger)- enjoy the distinct expertise that ombudsmen do not, they enjoy more flexibility and more active role for the judgement who can examine more, and less adversarial

- Tribunals have more flexibility in their procedures
than ombudsmen.
- Tribunals can take more inquisitorial approach compared to adversarial ombudsmen. (Facilitative and enabling)
