Re export inquiry

 

Hello!

 I request you to please guide on my below said query-

 Let we assume A is Exporter from Thailand.

B is importer in India. C is buyer in India.

D is buyer in Africa.

 

Initially B place order to A and imports one consignment . When material ship from Country of Origin and in transit, B plan to sell same material to C (Indian Company) on High Seas Basis. B takes full payment from C in Indian Currency.

 

As material is in Transit, still not reached India and at same time C plan to re export to D Buyer in Africa.

 

Is it legally possible that all above transaction takes place without touching Indian Boundary. If consignment needs to touch Indian Boundary then can Re Export takes place without giving Indian Customs Duty, CVD, etc. because we have not to consume/process in India, just re direct to further export.
