Fruad banakhat

My brother had received a civil suit notice  yesterday based on Fruad banakhat of land sale by frudster. 

The banakhat was never executed ever in past. The suit says that he has taken token money and not doing Dastavej hence the frudster had filed a bogus suit.

The suit may be filed by Bhu-mafia as per our assumption as we did not know him.

1.What are the remedies to defend the civil suite?

2.A police complaint can be filed separately for fruad banakhat against frudster as he had never deed  A banakhat? Will it help in the civil suit?

3.What are the important points to A. defend the suit and 2. to file a police complaint?

First of all appear before court either in person or through a lawyer, file vakalatnama, receive the case papers and file your written statement after which you can decide further course of legal action to defend your interests.

Take help of local lawyer to defend case in court. 

You can Lodge police complaint also.

Informed our stand with papers to  petitioner's Advocate, sensing fruad,  he initiated  to cancel the banskhat first by calling concerned parties, then he will  submit to hon court to draw back the suit.

What is advise at this stage now for me.

The suggestion from the legal and procedural aspect could only be appear before the court through an advocate and bring the alleged fraud to the Court's notice and seek appropriate reliefs. 

However, it is your personal choice to attempt to settle the issue through the plaintiff's advocate.

Fraudster has cancelled the said banakhat with all accomplice signs and copy given to us. Secondly, submitted an appeal purshis to cancel the ssid suite to hon court.

What could be the outcome?First hearing in August.

You can pursue the case through  the trial court by appearing during the first appearance through your lawyer and decide about the next course of action to challenge the case if it is still going on
