My client is manufacturing DILUTED NITRO GLYCERINE USP 10%
and holds all the permissions under the concerned drug laws from govt
However the Joint Chief Controller of Explosives came to the factory and said that
this drug (which is essential Cardiovascular Drug use full in heart attacks ) can not be manufactured
as per the notification of the Govt in year 2004 . and has stopped the production
The Explosive definition says " with view to produce explosion or pyrotechnic effect" but putting the case and
meeting with the Chief Controller also did not give and relief
Is a Drug which is exclusively used for medicinal purpose can be classified as explosive and stopped production
Please advice as to any related rulings or case law . I shall be very much thank full.
