Correction sale deed

A person purchased a  N.A plot  by executing registered  sale-deed . In the sale-deed the descripttion of plot is correct the boundaries well defind. the plot is not of regular size. the area shown in the revenue records was shown in registered  sale-deed executed. Latter on when the area surveyed by govt. authorities shows area more than in the revenue records. my quearries 1) Is it necessary to register the correction deed ? as boundaries are well defind . 2) If it is a correction deed or supplimetary deed ? 3) The stamp duty for it ? 3) The owner has given letter to the effect that he has sold the entire plot shown by defind boundaries. Please give your opinions with sections involved and judegements if any .

Dear Kvathalye,

Law is well settled that if a dispute arises, boundaries prevail over extent.

As ur query discloses that ur seller stated that he sold the entire land covered by the defined boundaries.  So, you need not worry even if the actual extent differ from the sale deed.  

Any how, to avoid future complications, if ur seller co-operates, you can ask him to execute a rectification deed to the said effect.  The said deed, on registration will become supplemental to the original sale deed.

Stamp duty varies from state to state.  You can enquire in the concerned Sub-regisrar's office.
