Respected GURUS,
I filed a divorce case in ongole district court in Jan 2012 , my wife filed a petetion for conjugal rights .
She got ex-parte decree in 2012 April . after 1 year she left to US and she is staying there till now
and left our only kid at her parents house , So she is staying alone in US from the past 2 years .
recently in March 2015 I got the result
1) Judge dismissed my petetion , the reason he mentioned is I didnot filed any petetion to set aside the decree of conjugal rights
owned my wife, but when I read the entire section 9 , its limitation period is only one year and there was no re union happend in the 1 year
so it leads to divorce , but in my case judge written like as I failed to reopen or set aside the decree of conjugal rights owned by my wife he dismissed my petetion "
But actually she mis used the conjugal rights , and even limitaion period of 1 year is also over , how can the judge consider the conjugal rights decree here...? .
I request experts to please guide me on this .
