Charges for building repairs

I am new to this forum. I have a question.

My parents have been living in a 2-bedroom flat for the past 20 years. The society has never undertaken any major repairs during this time. Maintenance was paid without fail all these years.

Recently, when our apartment’s walls started cracking, we informed the society and requested them to begin external repair work to strengthen the walls. Despite repeated requests, the society did not take any action.

As it became dangerous for our parents to live in the flat, we spent almost ₹4 lakhs to strengthen the internal walls.

Now, after two months, the society management is demanding ₹2 lakhs from each flat owner for repair work.

Is this justified? Can the society force us to pay ₹2 lakhs? What does the law say in this situation? Please advise.

Decision of majority of members present in general body meeting of the society shall have to be accepted, which has not been discussed in the facts posted.

All depends on the bye laws of society.

The society is right in demanding the funds from its members for the proposed renovation work.

You cannot deny the payment because you didn't wait for the society to respond instead you acted out of your anxiety by undertaking the repair work on your own which may be against the bylaws of the society.

Sir, The society refused to acknowledge the problems several times whenever the issue was brought up. Parents above 80 are living and the debris started falling of the roof hence we were concerned for urgency.

If it was really a precarious situation, you would not have gone for repairing the premises by keeping your aged mother in the same flat, hence you have done the repair work on your own for your own convenience,  which was not consented to by the association.  Now the society is taking up the major renovation work to whcih all the members are obliged to contribute hence you may not claim exemption for the reasons you stated here because you are living in the same society
