I had booked a flat with Migsun Wynn ETA-2 Greater Noida.
Details were furnished by dealers and I was assured that I do not have to pay a single penny above 4238000.
I booked flat by giving token money of INR 21000. Later at night, same day, I explored their brochures and was shocked to notice that I would be getting a bare shell flat. Estimated cost of Semi-Furnished was 420000 extra.
Later, when dealer called me to confirm booking, I was shocked again after knowing that they have added club membership extra which costed 1 lakh extra.
My budget was initially 40 lakhs but extended it by 42 lakhs 38 Thousand. But due to all this misccomunication from dealer, it as now coming to be around 48 lakhs. It was deal of suicide for me.
Dealer realized it was his mistake. I have whatsapp messages for this communication.
Somehow, I obtained NOC from dealer but now builder is refusing to refund the token money. As per him, I had signed application form and T&Cs were mentioned there that token money will be fortfieted in this case.
I am in a mess now. Please suggest if I can get refund of INR 21000 or not
