I have a home loan from a NBFC and Part payment of the loan was made to builder in the month of Oct 2014. Ever since he has received the payment, he has stopped the work on the apartment which is 80% complete but not enough to start residing in it. I have stopped payment on the EMI as I cannot pay the emi and the rent at the same time, what is the best course of action to take.

Stopping work is not the same as absconding !!
If the builder is keeping to the time schedule he has agreed with you, you have no case. If he is not, you should proceed with legal options .
