Sir, Kindly advise me, whether an application U/S 340 Cr.PC read with relevant section IPC'S is maintainable in an ongoing proceeding u/s 125(3) CrPC in a family court? whether Principal Judge will accept it?
As per Kusum Sharma vs Mahinder Kumar Sharma judgement the Delhi High Court has stated that in maintenance cases CrPC 340 is not warranted until disposal of main petition.
