Ancestral property

My husband and his brother have inherited a lot of property. They are now selling it and buying more land/investing in business. My husband, being a foreign national of Indian origin, cannot buy agricultural land so he letting his brother put everything in his name. Also the joint business option also favors my brother-in-law. How do I protect the rights of my children?

Dear Querist,

 

You are on dangerous ground. Tread carefully. Since you are attempting to do something indirectly which you cannot do directly. You are purchasing property BENAMI in your brotherinlaw's name. If he turns rogue tommorrow then you may have a hard time recoverying. hence it is advised that you consult a good law firm to put everything in black and white on a meticulously worded MoU (Memorandum of Understanding)/Family Arrangment to protect your interest.
