Ancestral land got captured by "Sanrakshit kul".

We have an ancestral land in our village. it is got farmed by one family and they registered themselves on 7/12 as "sanraksh*t kul". My father is registered as owner on 7/12. Is there any way, we can sell the land or replace that "Sanraksh*t kul" family with any other family by any mean? please reply.

Quick Summary
The discussion revolves around ancestral land registered under 'Sanrakshit Kul', effectively occupied by another family. The original owner, listed on the 7/12 extract, is seeking ways to sell the land or remove the current occupants. Advice suggests filing an eviction suit before the 12-year adverse possession limit is reached, as 'Sanrakshit Kul' may indicate protected tenancy under local laws.

Dear querist,

You cannot sale the land which has sanraksh*t kul remark on 7/12 extract. If possible negotiate with that person.

The facts posted suggest that it is a case of protected tenancy;it is not anuone has "captured" the land. The matter needs to be dealt with in accordance with local law rwlatng to tenanacy.
