advice

someone hacked my mobile phone and he was able to listen each conversation by me through the mobile phone so the thing is I got that my mobile phone is hacked and I made a defamatory statement against the hacker and he listened my statement now can the hacker file a defamation case against me? I did not make the defamatory statement public though

Quick Summary
A user is concerned that a hacker who illegally accessed their phone and listened to conversations might sue them for defamation. The user made a statement about the hacker while on the phone, but not publicly. In UK law, for a statement to be defamatory, it generally needs to be published or made public. Therefore, if the statement was not shared beyond the private conversation, it's unlikely the hacker could successfully bring a defamation case.

Hacking is itself a crime.

I know that but I also made a defamatory statement which is also a crime so can he file any defamation case against me?

Defamation does not sustain if not made public or published. Moreover a true statement doesn't match defamation.

He can file suit, but taking cognizance of the case by the court matters most!

I did not make it public or publish so he can not case against me right?
