Adoption of step children by step father

Hi iam a mother of 12 years old son and 10 years old daughter. Both are disabled children. Iam legally divorced and remarried. Now my current husband wants to adopt my children to give his name. We are hindus. my children and my current husband belongs to same caste. We want to change the surname of kids in aadhar cards. What is the procedure. Kindly suggest and please help me

Dear querist,

You need to NOC from your Ex husband as he is biological father. Consent of biological parent is required for adoption.

You need to contact Sub register office for registration adoption deed. In case Sub register office demand decree from court then your current husband needs to file for adoption under Hindu Adoption and Maintenance Act, 1956
