A2&a3 passport taken

Hello All,

My parents (A2&A3) were in Jail due to false 498a and they came out and got regular bail 3 years ago. But their passports were taken by lower courts.

Tell me the process to get my parents passport back...

Should I apply a petition in lower / session/ high court?
Petition under what sections of Crpc?

Kindly send  me the judgements and citations that I can use in my petitions which tells that court should not take the passports.
