A political party member as a member of a registered society

Dear all,

  1. Is there any restriction on a person who is a member of a political party from becoming a member of a society registered under Societies Registeration act?
  2. If there is no such restriction, then can such a person become a member of the governing body of that society?

Thanks in Advance

Regards,

Geetha Gupta

There can never be such a bar in democracy, please find out such bars if any from going through bye-laws and also get information under RTI from Registrar for confirmation.

1. A Flat owner becomes a member of a Society, irrespective of whether such a person is a Politician, a Leper, a Beggar or whosoever. However a criminally "convicted" member or a "society dues defaulter" is barred from becoming a member of society's governing body.

2. Once membership is granted, THEN there is no restrictions WHATSOEVER & WHICHSOEVER, for such member to become Committee member or governing body of Society, PROVIDED the general members elect him in a duly called society election proceedings.

Dear All,

I should have clarified better. Apologies.

My question is about NGOs registered under Societies Registerartion Act, 1860.

So as per G.L.N. Prasad ji and Real Soul ji, it depends on the Byelaws/Rules and Regulations of the NGO because the Act as such does not debar such a membership. Can you please clarify?

Hemant ji, i suppose, in the case of a RWA, there is really no other way.

Thanks for the response

Regards,

Geetha

1. IF  "Shri Raj Kumar Makkad'ji" has clarified & consistently confirmed FOUR times, THEN rest assured, that opinion is 1000% legally sound & enforceable.
