is pil effective in bringing about a social change?

Dear Friends,

Public Interest Litigation (‘PIL’) is a potent instrument in the hands of the spirited citizens of India against any wrong done to the public at large. Please share your opinion as to how effective is the tool of PIL in bringing about changes in society or are they as sacrosanct as they are made to be?

PIL is a broader aspect in each and every sense , It is the path thrugh which you could drag the attention of justice but isnt there another appaling reality that the PILs are used in the legal system with a malicious intention and hidden personal gains??????????

Let us not make much of PIL. Most of them are thrown out before admission. Those we read about are by way of exceptions and examples.

mr  anil sir is right. i started a pil; but the concerned judge refused to admit it on saying that we (the judges) should not go much advance.

i was hopeless and stop the matter.

however i shall encourage every such steps for the interest of the nation.

it is seperate matter that these may not be admitted. by the irresponsible judges.

After RTI act enacted scope of PIL can attain a different height. Public interest litiation is directly proportionate to the interest that public have in welfare of our society. Best anology that can be cited is that of human physiology. During life time of a educated citizen despite having complex system in body such as cardiac, kidney, liver etc we don't bother to understand them or try to gain knowledge about the systms we have. Life time is spent without understanding  our own body. So also we don't bother to study our constitution. We are society practicising democracy without knowing what is democracy.  In that context apparent public interest litigation is rare.

Left to themselves, judges take notice of newspaper articles and convert them into PILs. But we mortals are at their mercy.

PIL forwarded by the judges by seeing the news paper articles are however considered as judicial activism which is the integral part of Art. 13 also it is the only reliable source in these days for moving a palm against the social mafias........................

Govt sees red when SC/HC take up PIL. Executive wants to be above SC/Constitution/Parliament. Autocratic rule. We have read: KING CAN DO NO WRONG.
