Functional autonomy granted to police by supreme court

in a case called Prakash Singh & Ors vs Union Of India And Ors on 22 September, 2006 the SC ordered the central and state govt. to implement seven directives enumereted in new police act drafted by soli sorabjee committe. these seven directives is classified into 2 catagories:

 

1] those seeking to achive functional autonomy

 

2] those enhancing police accountability

The Supreme Court granted an extension of three months to comply with the four other
directives, which require more thorough considerations to be implemented. These
directives must be complied with no later than 31st March 2007. States must file
affidavits of compliance by 10 April 2007.

 

but will indian police achive functional autonomy in 2012? is police free from political grip and get their functional autonomy till date?

 

the answer is NO. why?

The reason is very simple if you get the answer to this question - Why has the entire set of laws and bureaucracy that was designed to extract wealth of this country been kept intact even after August 15, 1947?

 

Because the goals of the colonial rulers and the present rulers is same. Earlier money went to England, now money goes to Swiss bank and other underground accounts. In order to do this you need to keep people carefully disarmed and suppressed. Police or police state does the needful.

Extremely large and powerful movement is needed to change the system which no corrupt politician or bureaucrat or any vested interest will desire. Our politicians know how to fool the people of this country and win elections on non issues or irrelevant matters.

 

When they can get elected by useless populist measures like giving a bottle of whiskey or Rs. 500 in return for votes, why will they bother to change the system? Exactly because of this Lokpal Bill has been kept in cold storage for 40 years and still the same. On the other hand when Bill required to increase their own salaries was required to be passed, it was passed in a wink. In short people of this country have practically no control over the State or its components they have supposedly created under the Constitution.

today i read the new police act which gave functional autonomy. i am telling you now how ridiculous that act is.

 

the objective of functional autonomy is separation police from state govt. the new police act is just an eye wash.

 

the state govt. is the real cause of decay of police activity. the obvious remedy was autonomy i.e separation of police and state govt. but the cunning politicians did not do that. rather in new police act they are establishing some institutions to look after police viz: state security council, police establishment council, police complaint council etc. all these institutions will be established by the state govt which is real cause of decay. so under new system there are some intermedieries between state govt. and police: these institutions.

 

so what new change is there? the same state govt and police are there. only some new middlemen has come in between. the result; same lower class police activities with more complication in procedure.

what a ridiculous thing soli sorabjee & co. can do!!!!

 

now what should happen?  the cause of problem state govt. should be separated from police.  police should be brought under control of judiciary. police should impliment court's order and will not care the threatning of political leaders.

 

the old system:

state govt. + police = corruption

 

the new ridiculous police act ( continuing the old system)

state govt.+ institutions+ police= more corruption + complication

 

the new system:

judiciary+ police= no corruption

 

so you see how tricky and cunning our politicians could be.
