406 case

i filed dv act last year..i even attached the list of istridhan...... i want my istridhan back..but my hubby has mentioned in the court that i have taken away all my jewellery..however fact is its lying with my in-laws.....

what serious action can be taken against them ?? one shud file 406 ?? but the problem is i have no proofs that my parents gave this much of jewellery to me ......there are no bills.....no video record....nothing........... will the court ask for proofs ??

Indeed

The court will ask you for proof. 406 IPC is a criminal prosecution. The onus is on you to lead evidence to prove that the gifts were given.

@ ashish : ok..but i have no proofs...... oral evidence is not going to be enough ??
