'L'is the  Twelfth letter of the English  Alphabets and the 'Eleventh'letter in the 'Latin'. 'L'as symbol, is used in Roman numerals for: 50'L';  'L is abbreviation for Law as well as Lord.  In the world  the  first Law exams was conducted by 'Lagem Laureus Bacca'an  Italian in the 18th Century.  Based on his contribution and  memory some of the Universities awarded 'LLB'Degrees for qualified Law graduates. Some Universities awarded 'BL'Degrees for qualified Law graduates. There is no difference between either 'LLB'or BL. Both degrees are same as well as equal status in Indian Legal education Environment.

LAW : (Concept)

In the real and practical world of legal environment we can understand the word 'Law'in two dimensions:

A) Implied Dimension
B) Applied Dimension.

A) IMPLIED  DIMENSION:

'Law'includes any Enactment, Ordinance, Regulation, Order,  By-law,

Rule, Scheme, Notification, or any other Instrument having the force of law.

Law  is a command of the sovereign enforceable by sanctions. Body of rules which must be obeyed and conformed to, by citizens on peril of sanctions and legal consequences. A principal of conduct observed habitually by an individual or a class.  

Jurisprudence is concerned only with positive law, that is, commands or set of rules imposed by or with the authority of the sovereign. The term embraces all acts of parliament, of state Legislatures, the rules and regulations promulgated under the authority of such acts municipal bye laws and also, the judicial precedent or law as declared by courts by Judicial Decisions.

The Phrase 'Law and Order'is to be understood with reference to two other expressions namely 1) Public Order  2) Security of the State and they have been conceived as three Concentric Circles. One has to imagine three concentric circles, the largest representing 'Law and Order' the next representing 'Public Order' and the smallest representing 'Security of the state'. Thus any act my effect, 'Law and Order' but not 'Public Order', just as an act may affect 'Public Order' but not 'Security of the State'.

B) APPLIED  DIMENSION:

When men are pure, law are useless, when men are corrupt, laws are broken.

In University, they don't tell you that the greater part of the law is learning to tolerate fools. Law grind the poor, and the rich men rule the law. Necessity Knows no law. There is no worse torture than the torture of laws. In law nothing is certain but the expense. There  is no better way of exercising the imagination than the study of law. No poet interpreted nature as freely as a lawyer interprets truths. If you like the laws and sausages, you should never watch either one being made. Ignorance of the law excuses no man; not that all men know the law, but because ‘this an excuse every man will plead, and no man can tell how to confute him. Possession is nine tenth of the law.  A law which affects injuriously and unjustly even one human being is bad and must be changed. It cannot be helped, it is as it should be, that the law is behind the time. Finally the purpose of law is to prevent the strong from always having their ways.

'JUDGE', JUDGMENT : (Concept)

In the real and practical world of legal environment we can understand the word 'JUDGE' in two dimensions:

1) Implied Dimension
2) Applied Dimension.

1) IMPLIED DIMENSION :

 A  Presiding Officer of Court of Law is called 'Judge' The term 'Judge' denotes not only every person who is officially designated as a Judge but also every person who is empowered by law to give, in any legal proceeding, civil or criminal, a definitive Judgment or a Judgment which,  if not appealed against would be definitive, or a judgment which if confirmed by some other authority

Would be definitive, or who is one of the body of persons, which body of persons is empowered by law to give such a judgment.  A Judge may be

'de-Jure' as when he has been duly elected or appointed and exercises the office of judge as a matter of right. A judge 'de facto' as where he occupies a judicial office under some color of right and for the time being performs its duties with public acquiescence though having no right in fact.  Pro tempore 'that is for the time being as where a member of the Bar acts by consent of the parties ass a judge. Finally a Judge is an officer who presides over a court or tribunal organized for the purpose of administering justice. His function is to determine controversies between litigants. Judge advocate an officer or a court martial, who combines the character of advisor to the court with that of public prosecutor. Judge means a Judge of High Court, or Supreme Court includes the chief justice of High Court, or Supreme Court, or an acting Judge, an additional judge of High Court, an acting chief justice of Supreme Court.

Judgment means the act of determining as in court what is comfortable to law and Justice.  The statement given by the Judge of the grounds of a decree or Order. A Judgment is the Judicial determination, the decision of a court upon the respective claims and rights to an action therein litigated and submitted for its determination . In Criminal cases, the term means adjudication by trial court that defendant is guilty or not guilty and, if adjudication is guilty, it includes sentence pronounced by the court.

2. APPLIED DIMENSION;

Judges, like people, may be divided roughly into four classes;

"Judges with neither head not heart- they are to be avoided at all costs; Judges with head but no heart – they are to be avoided at all costs; Judges – they are almost as bad; than Judges with heart but no head – risky but better than the first two ; and finally, those rare judges who possesses both head and a heart - thanks to blind luck, that's our judge.  Judges ought to be more learned than witty, more reverend than plausible, and more advised than confident. Above all things, integrity is their portion and proper virtue. We judge ourselves by what we feel capable of doing other judge us by what we have done. Four things belong to a Judge; to hear courteously, to answer wisely, to consider soberly, and to decide impartially. Never be a judge between thy friends in any matter where both set their hearts upon the victory. If strangers or enemies be litigants, whatever side thou favorest, thou gettest a friend; but when friends are the parties, thou losest one. The Judgment is like a pair of scales and evidences like the weights, but the will holds the balance in its hand, and even a slight jerk will be sufficient, and in many cases, to make the lighter scale appear the heavier.

JUSTICE; (Concept )

In the real and practical world of legal environment we can understand the word 'Justice' in two dimensions:

1. IMPLIED DIMENSION

The term 'Justice' means Upholding rights, enforcing duties and punishing wrongful acts. To achieve justice is the ultimate aim of the law. Justice, equity and good conscience is an important formula in context of Justice. The origin of this formula lie in Roman Law. The scheme was evolved out of practice of medieval cities of Italy, France, and Germany.  Even Mr. Aristotle took pains to explain the needs of this formula. In course of time these ideas were developed in England, and incorporated into her legal system. Thus the preamble to the act of succession, 1925, contains the words Equity, reasons and good conscience. These do not the source of law, other than Common law and statute law. The East India Company carried these concepts to India.

2. APPLIED DIMENSION:

Justice means life for life, Eye for Eye, tooth for tooth . Justice Delayed is Justice denied. It is better that ten guilty persons escape than one innocent suffer. Injustice anywhere is a threat to justice everywhere. No man can justly censure or condemn another. Because indeed no man truly knows another.

You shall judge of man by his foes as well as by his friends. Justice without force is powerless; force without justice is tyrannical. The law is made to protect the innocent by punishing the guilty. Do you know that 'No, No said the Queen. Sentence first – verdict afterwards. Justice is the only just man enjoys peace of mind. That is better hundred guilty persons should escape than that one innocent person should suffer, is a Maxim that has been long and generally approved. Judging from the main portion of the history of the world, so far justice is always, in jeopardy. Injustice is relatively easy to bear, what stings is justice. We do not ask any favours, we only want justice. He who decides a case without hearing the other side, though he decides justly, cannot be considered just. Justice discards party, friendship, and kindered; and is therefore represented as blind. Justice is a machine that when someone  has given it a starting push, rolls on of itself.  Justice is itself the great standing policy of civil society and any departure from it, under any circumstance, lies under the suspicious of being no policy at all. Justice must not only be done, it must be seen to be believed. Finally, Justice is truth in action.

see today abt 2 lac jobs in IT sector would lose in 2017 only in the case of IT engineers working ; IT Engineering colleges cannot be more than needed not fully, always there will ought to be 'gaps' between supply and demand (economic jugglery) that need to be maintained, if not what is happening today in IT industry bound to happen - governments bound to fall if the governance do not have a broad based technological education so in every sector - you can't wind up old industries systems - keep always reasonable gaps but allow time for people to readjust for human mind cannot readjust at lighting speed is very obvious, why the governments fail , just politicians being scoundrels and school drop outs they assure more and promises not to be fulfilled and poor citizens are fooled that is what RK Laxman political satirical cartoons in 'You said it' did - his cartoons most liked, there is no cartoonist of his calibre today , in fact he is one a self learned man , he never took any diploma on cartooning or arts but he worked himself throughout his life, bala saheb thakeray being a cartoonist did not sustain in cartooning he was no comparison in sustained work of cartooning so he jumped to politics an easy scoundrelism kind of job so he shifted - that way most in politics just heartless humans , so too in the business of 'swamijis' is another type of scoundrels ; they assure some promises fully knowing no direction, that led them to raping so that they can keep women under control so too politicians also indulge in rapes lest the party loses.... that way when you can't do things you resort to all kinds of corrupt ideas, that way we all landed on all kinds of corruption , for corruption gives big returns to practitioner by way of revenue, obviously the one approached these rascals - so corruption is a product associated with all idlers , mentally just arrogant politicians like Kadam of NCP party who abused the Mumbai police man , and another of shiva sena misbehaved on an Air India flight from pune to delhi who hit the Air India staffer with his slipper - all these examples would show what kind of idlers as your so called law maker - so obviously every political party - see Mr .Modi obviously kept his wife high and dry obviously, he too some kind of these kind of politicians, so too Jaitley and others - never be misled - but fact is 'X' (idlers) kind of men or women are too many , compared to 'Y' (active contributors), so Pareto said 80% of idle people are supported by hard work of 20% of men or women - in a joint family 80% obviously supported - but in nuclear families 'cat is out of the bag' ; so joblessness is apparent and many starve and many are rogues - like swamijis or political workers and such inane occupations obvious cause a lot of corruption' that way rich man and so called businessmen with fake kind of businesses providing useless products that guzzle away what you earned by real hard work... that way our law and order is not working obviously. Obviously most work is useless.....one needs to know that your knowledge will provide as 'idlers' are all around you every where right from top to the low levels of life... but justice need to manage by the Judiciary system but Judiciary is failing like that of Mr Karnan a useless judge at a high court, when caught he talks idly simply throwing all kind of abuses - that way judiciary is getting infested y these white ants . these white ants are there in every profession or occupation falling under raps of 80% idle community. .....

what is judging is all about? Knowledge is to know the extent of one's ignorance. That way the government governance is to ensure sustained jobs? stained jobs is impossible as there is always attritions normal like a life cycle of man is - you 'r born you r to die , so every technology, every manufacturing sector,has to, so life cycle of anything is never permanent, that way the very life of anything is bound to; governments just do macro work concerning all it is representing in the state; it cannot move into micros, micros die faster like a glow worm is, so governance by government is to concentrate only on micros certainly not on micros, so judgments of courts is a general guidance on the basis of the constitutional provisions, the 'statutes' of states mostly tilt as if it is standing on two or three legs, not reliable at all, wherever the court finds some lacunae it obviously need use doctrine of severability of sections or set aside the very statue on the basis of constitutional tenets that is the rule of law.....

see in ICJ she said 'india obviously moved seeing no options but ICJ; that is itself not diplomatic enough effort - india could have asked USA , UK, Europe to interfere in the issue if Pakistan failed its trade would be stopped with USA, UK, and Europe, that way diplomatic effort works or by sheer threat of war - yea india could have dealt as she did in the case of Bangladesh that way it could have liberated Baluchistan, and other peripheral Pak territories as Pak itches for war as its arsenal need be tested and be actually decimated then pakistan could not wag tail see - Musharaf what he says Jhadav worse than Kasab means - he accepts Pak only initiated 26/11 on mumbai attack is obvious - read between lines - no use Ujwal Nikam ideas for they can't work is indeed a fact- he knows obviously precious little in international laws - no use to rely some electronic media calls this man for his opinions obviously good for nothing , is obvious and absolute. Salve a good man but he shd have insisted if india has its man in the judges, pakistan too shd have that is natural justice - but he failed - any way ICJ judgement can be questioned at the issue of natural justice front - human rights is mandatory - u can't deny to pak too that right is available to pakistan, that way pak request to rehear may be placed but it is for ICJ to accept or not for pak did not raise at the time of hearing by ICJ of the jhadav matter - any way now Jhadav cannot be hanged by pakistan, even if consular access is not given - but it has to wait again ICJ directions as stay of execution is as absolute as anything. Indian govt yet to learn the art of governance but what i see today BJP govt is some publicity oriented more than its own ability to govern thank god you have a right man in president mukherjee - i don't think BJP can't provide any better candidate by ir or the opposition in the parliament , i am sorry for my comments it is without any malice on any - but what use obviously prolonged dispute - play the law properly if not you only fail - small success is no big success at ICJ - one needs to know - that way we say Knowledge is one knowing what little we know is development of knowledge - confucius said ' knowledge is to know the extent of our (own) one's own ignorance' - how true!

Law and its diamention are indeed are many and varied - as i told no law maker is rightly equipped to make a bill of any law for a statute - that way what govt understood on ICJ for jhadav is apparent....

think a little whether statutes are worth the paper wasted on the so called statute - whether is it worth how many million hours are wasted by these lawyers friends wasted , obviously made litigants wasted on the lawyer souls by spending their hard earned moneys just because of so called 'LL.B or B.L degrees conferred on these worthless creatures'' by so called universities and bar councils - think every lawyer worth the name would commit suicide, if he or she is really honest to himself or herself, but like political scoundrels these too are just thick skinned ' they understand nothing - of 'conscience' - many just join the political scoundrellism and become super scoundrels that way some fake ideals these worthies do practice...due to so called education we tout about mostly made by the scoundrel law makers....that is the world facing for one's own self destruction....

Politician being brn scoundrels suffer from jealousies and do imitate , in fact, no two humans if born as brothers obviously drastically different - that two political scoundrels are similar but obviously play different scoundrellism -after all 24 chromosomes is supplied by male and 24 chromosomes supplied by the female as father and mother - yet every offshoot cannot be identical , reason is every 300, 000 billions of births if same parents produce one may resemble but obviously impossible task - so no two humans if blood brothers cannot be same - when so how we conceived caste system -obviously a fraudulent task perpetrated by political scoundrels - besides you eat foods that also has similar problems like chromosomes... what reason these political scoundrels reason out in their so called ' position of law makers' obviously they fool the ignorant people by slogan mongering - or so called manifestos not worth to be festoons too, ...

Agn, see there is nothing wrong when RK Laxman political cartoons rightly called politicians are turn coats misuse their elected position - would you like to allow that elected msan take public for granted , that way you need public order but is missing now siddatramaiah of karnata as CM is accused he machimated to eliminate an IAS officer Tiwari at a U P guest hse in Lucknow, but yet that man still a CM being an accused what is the police doing where is law and order or public order , he may be any thing CM or PM or any thing he need to be arrested , is it happening in india what kind of laws are taught in the universities what kind of teachers we have some 'docile' men - where is so called justice . this CM siddharamaih has to his credit is accused to have killed or made many IPS or KPS officers commit suicide.. what kind of india we are proud of?.. think a little - are you a sensible advocate - can you defend yourself as a sensible advocate to follow advocacy as a court officer - mostly not - but most judges work honorably but lawyers obviously failed - so these so called lawyers only are responsible for fall in judicial system - some Karnan's have infiltrated judiciary how that is rocking the judiciary - he ensures to waste the court time at the cost of poor litigants in small or big cases - so lawyers after securing their LLB or BL degrees play havoc to the public order ....so whom to blame 'constitution ' or these worthies as lawyers ?

true, see Mr Justice (retd) Katju said AP govt shd be dismissed, why he said, 'a dalit woman was abused by AP govt personnel or politicians, obviously he is right as politics is nothing but scoundrelism played to the full as rowdies do on during the course of any one walk on the road - see in TN, bike borne fellow abuses old man when he crosses the road or junctions , as he drives his bike at uncontrollable speed, do u call him some good citizen, obvious none would call him a god citizen , he has to be arrested and his abuse he need to pay exemplary liquidated damages under law of torts....
