My husband filed a case against me in Lok Adalat

(Querist) 31 January 2016 This query is : Resolved
My question is "Is the decision given by LOK ADALAT final, can I file a case aginsst him in civil court " ?
Devajyoti Barman (Expert) 31 January 2016
The decision arrived at in Lok ADALAT is always on consent of both parties and once that is done no such decision can be challenge in higher court.

What prompted you to raise such a query ? Was the decision in question arrived at in the Lok Adalat, not with your consent ?

In any case, as per the provisions of the Legal Services Authorities Act, 1987 - governing the Lok Adalats, the decision of the Lok Adalat shall be final and binding on the parties and no appeal or revision shall lie to any court against such decision.

Which court has called you for hearing?

Lok adalat
Raj Kumar Makkad (Expert) 31 January 2016
You cannot be forced to reach to an amicable settlement in Lok Adalat if the terms are not suitable for you or say not acceptable to you. Lok Adalat is an effort of the courts to bring the conflicting parties to reach an amicable settlement. If it fails the case is sent to the regular court so don't keep tension.
