lift maintenance when case is in consumer forum

Hi Experts
I would like to ask one question. We are filing a case against promoter for substandard and incomplete service he has provided in the premise which includes a non functional or partially functional,lift.
What I would like to know if the society will be able to take applicable measures to make the lift functional and working so that residents don't have to face problems.

society can award contract for repairs and upgradation of lift. claim amount spent on lift repairs from the builder

You can file case in consumer forum and repair the lift in the mean time. The expenses will be taken into account.

Serve a legal notice to the builder demanding the rectification as told failing which file consumer complaint.

Send notice and file consumer complaint against the promoter / builder.

1. Send Notice to Promoter demanding to rectify the repairs within reasonable time.

2. If no response, file a consumer complaint

3. Parallely, rectify the repair at society's cost.

4. You can get the remedy of refund of spent amount from the promoter

I agree with the experts, get the lift repaired through society funds simultaneously issue legal notice to promoter followed by consumer complaint, if there is no (or positive) response.

Send Notice to the promotor to rectify the defect within specified period. If not, file complaint before consumer forum and under the knowledge of the forum rectify the defects by you and claim costs and compensation.
