Change of job

I am currently working in a Central Govt. PSU. Seeing advertise from UPSC, I am interested to apply for a job which, I think will enhance my professional advancement. UPSC demands intimation to my Dept. Head whereas the PSU in which I work insist in the procurement of an NOC which they hesitate to provide. The experience certificate requested for the purpose of applying is also not intended to be released, presumably. Is there any provision that gives me the right to demand an experience certificate? Can I be penalized in future if I proceed without an NOC?

You cannot be penalised for proceeding without NOC.However,you are to apply to the Head of PSU, who shall issue NOC, it is permissible.

You are having unnecessary apprehensions. the present PSU has to forward your application to UPSC at your request.
Hence you make an application to the present employer enclosing the UPSC job application with a request to forward the same to UPSC. This is called applying through proper channel. In the covering letter addressed to UPSC clearly mention : Through Proper channel:(giving present employer's address). However, since your present employer is PSU, they may take their own time for forwarding the same, but ultimately they have to forward it.

In the meanwhile, the same copy with the same covering letter can be sent directly to UPSC to save delays in routing through the application through proper channel.

Once they forward your application, that itself is NOC. Even if they do not forward in reasonable time, your application will be treated as applied in time as you were sending an advance copy to the UPSC.

However, you have liaison with your present employer and see that the application is forwarded.

This is the normal procedure when a PSU employee applies for the other organisations.

Agreed with experts.
Follow the explained process and submit everything under proper acknowledgment, and do not leave anything to chances.
You will be better, informed by meeting officials in PSU, UPSC.
You can develop rapport also that may help you.
Various publications/threads would show that your query is not without reason.
You may in fact have to struggle and handle the rules and tactics too of officials in PSU.
It shall be appropriate to go thru the Dept. Rules on NOC/experience certificate and preferably download a copy/obtain thru RTI, and show it to your lawyer.

Submit your application under proper acknowledgment to PSU-Head and Request the Head of PSU to forward your application to……………………………….(full address as given by UPSC) and you may add that a postage prepaid (by affixing postage stamps of Rs………………./OR as purchased from PO) envelope with address of UPSC affixed on it is attached for sending your application by Redg. Post only, to UPSC and another prepaid (by affixing postage stamps of Rs………………./OR as purchased from PO) envelope with your address affixed on it is attached for sending the authenticated copy ( of application and communiqué sent to UPSC) by Redg. Post only, to you.
You may also add that dispatch details/number and copy of redg. post receipt of dispatch to UPSC, may also bee provided to you.
Pursue, IN TIME, thru RTI if required.
Obtain NOC in time, before joining next job.
Please update in this thread how did you succeed to get NOC.
It shall help many of the fellow citizens, and countrymen.

Discretion of the employer is paramount in case of NOC. Also, you cannot ask for experience certificate as a matter of right, except after resignation.

Application for employment elsewhere, if not sent after formal permission of the competent authority or forwarded through proper channel, is considered as indiscipline on the part of an employee, which can attract disciplinary action against him. You can, however, send advance copy of the application direct to the UPSC, which can ensure consideration of your application, if reaches in time. But selection, if made, would subject to receipt of the original application through departmental channels, may be later than the fixed last date of application.

Thank you all sirs especially to Malipddi Jaggarao sir, Dr. J. C. Vashista sir and Kumar Daob sir. On course of time now my Dept. head has agreed to provide the NOC but insists on accepting the application for experience certificate only after the procedures of NOC are completed. Time is the constraint as the last date of submission of application is clossing and certificate of experince is required to be uploaded; I doubt I haven't specified that this is all about an online application. Once again thanks for all the advice; looking forward for more of this sort in future. Nice time for all.

If experience certificate is needed in advance, try to convince the authorities by showing Ad for recruitment. They have the discretion.

Apply rapport goodwill and exceptional levels of persuasion,persistence skills and like your made your HOD agree for NOC obtain experience certificate even if provisional................
