Playing in parks

we play football in park which i located near to our house,in sector 6, which is under HUDA(haryana urban development authority) maintenance. till date now mirror of any house has been broken. no other damage done due to playing.playing persons are of diff age group...13 years to 22. all play together. we play football from 8 30 to 9 30pm so that no other person is disturbed. there is road along the boundry of park....and thereafter houses. people whose houses are around park...object us from playing there. do we have leagle right of paling?...police has been called 2 times... every time they make us to go away and stopped us from playing. do they ahv legal right to stop us from paling?...no damage has been done to any people around the park,no mirror broken,no damage done to cars standing nearby parks. police officilas talks very rudly to those who play there. now it has been decided by elders that no one will play in park. they said it is for walking ...and small children can play . what action can we take against this...??

Park is no doubt not a playground especially for big games like foot ball or cricket. Just not causing any damage cannot be claimed as a right to play there. It is meant for recreational purposes only and such big games may be a disturbance or even nuisance for park users, ofcourse, it depends on how people approach. It has been objected, why create problem for everyone? Better choose a playground elsewhere.

Thts the point there no playground nearby....we are just asking 1 or 2 ht only in the entire day...morover article 31 of united nation convention on rights of child clearly stipulates that every child has a right to play an the state should encourage them to paricipate in such events

File a writ petition so in future on obstruction is caused for such play.

You can file an application with the lok adalat functioning at the local park. Make Huda and the local municipality/panchayat a party. No expenses are involved in filing such an application.

Try to have amicable solution. legal way is long and time consuming. You may approach the RWA and HUDA authority to permit you for one hour play.

parks are meant for enjoying morning and evening walks and not for playing football and thus go to separate play ground.

you are playing at night between 8.30 pm to 9.30 pm . it must be causing disturbance to residents . make an application to HUDA that you may be permitted to play football at night for 1 hour

playing football at night is even more fatal

as it may hit anybody causing injury and thus

play it in proper playground meant for it.

No playground is availabl bearby...der is a stadium very far from our house....several km away....and there is too much rush in that stadium.....now when the govt is not able to provide adequate sports facilities and infrastructure......where will we play....evryone wants young generation to stay healthy and participate in outdoor games.....and to keep their children away from video games,tv,comp.....then why people are not ready to let us paly there. We play peacefully

If no restriction board is put by HUDA, you cannot be restrained from playing in the park. However, any damage to property of the residents nearby only you would be liable bear with.

Playing football like games keep us healthy. They prevent us from serious desises like diabetes,heart problems,obesity,hypertension....and several others. These diseases make govt to spend huge expenaes on health plans and programs which consume huge part of our GDP. These expenses can b saved simply by participating in good physical activites and outdoor games.

@ PS Dhingra....thanks sir.....but police came and stop us from playing....they even talk to us in a very very rudly manner....which is highly untolerable....what can we do in toward this....they even make neighbours to file complaint on single individual......and thus turning a common issue to one to one issue

Intervention of police can only be due to creation of nuissance by you people, otherwise you could have questioned even the police whether there is any restriction from HUDA.

I have already stated, if there was no nuissance on your part, "you could have questioned even the police whether there is any restriction from HUDA."

Sometimes all the questions do not have answers, to find an answer to such questions, you must look for an alternative question which will have answer to both. Thus, if you look at the issue from others views, you will find a solution to your question. If you do not have a playground nearby, do not play foot ball, instead play some other small game out of which also you can exert fatigue and burn colestral etc. If you start finding fault with everything there is no end for any thing. While living in a community, adjustments are necessary.
