Yes! youcan call a witness fromManagemeng side,.. Unless both the parties workers/employees and theirManagement are heard etc how the proceedings will go on and how thejudgment wilbe delivered favoring one side or the other.

Case is on the evidence of the workman. I want to call one witness from management side who is adminstrator so that I can prove my case. Can court allow the same and can I ask him certain to bring before the court.

Yes, you can call any person as witness; that includes a person from the management. However, before venturing so, please weigh all the pros and cons as such a step could be quite a double edged sword.

You may call the witness but do you think management person shall depose against management and you can get benefit out of deposition of such witness, consider before summoning.

The witness called from management side will be crossed by the advocate of management. Will I be able to ask any questions.

Since you call the witness, he will be known as your witness, not management's witness. So, you will be able to examine him in a normal way to produce the requisite facts and figures as available on record, but can't ask leading questions.

Contrarily, your opposite lawyer would be free to put leading questions during his cross examination to scuttle down your theory, if not based on facts on record. So, you will have to be cautious not to ask any question that may not be available as a solid evidence on record.

More so, if the witness renders some information at his own accord, but not able to sustain during cross-examination by the opposite party, he can also be subjected to departmental disciplinary action for deliberately rendering fake evidence.

In addition to the advice of various experts, I may add --

If you are able to convince the judge to call him as a court witness, you would be able to get the opportunity to cross examine him also to dig the facts of your favour, which are not found on record or some manipulations in record are noticed by you.

Summons issued by court to witness. Can now management ask the court to cancel the Summons and if witness does not appears.
