OVERVIEW 

The High Court of Bombay has granted three-week transit anticipatory bail to Nikita Jacob, lawyer, and activist. A non-bailable warrant was issued against her in Delhi in the toolkit case.

The case was registered by the Delhi Police Special Cell, and while ordering bail for the advocate on a Rs. 25,000 personal bonds and sureties, the Bench observed that the protection is being granted to enable the applicant to approach the competent court to look for relief which they seem appropriate.

The Aurangabad Bench of the High Court had permitted ten-day transit pre-arrest bail to Shantanu Muluk, engineer and activist. A warrant was issued against him in the same case in Delhi.

WHAT IS THE BACKGROUND?

The Delhi Police had accused both Jacob and Muluk of creating the toolkit on the protest of the farmers that had been tweeted by Greta Thunberg, the Swedish teen activist.

Jacob was charged under Section 124(A), 153(A), and 120(B) of the Indian Penal Code (IPC). These sections deal with sedition, promoting enmity between groups, and criminal conspiracy respectively.

The Delhi Police had argued that Jacob was part of a larger group formed to support the protests of farmers and that the toolkit document was created even before the riot happened in Delhi on Republic Day. The document had mentioned the steps that need to be taken.

ARGUMENTS BY JACOB'S LAWYER

Senior Counsel Mihir Desai, Nikita's advocate stated that his client's plea to get the bail was maintainable. He referred to the case of the Tandav web series in which the makers of the series and a creative head of Amazon Prime were enabled to approach for relief in a court in Lucknow.

He also stated that Jacob is a supporter of environmental causes, and a lawyer, she has nothing to do with Khalistan. He also asserted that the toolkit which was allegedly created by her does not talk about any violence, and was prepared only to support the farmers.
