withdraw of cheque amount in appeal by complainant

court had convicted the accused and compensation for one month later on the accused preferred appeal before session court and accused deposited 40 percent amount there . now the complainant desires to withdraw deposited amount . is there any citation then plz help me.

The deposit is a kind of surety. Complainant cannot withdraw it.
