What next?

Dear Experts,

Mr X has been falsely implicted under IPC 408,420, 120 -B, 467, 468, etc. Later on during chargesheet only 420 & 408 were standing. Rest were deleted. Now since two years the suspect is regularly attending the court. But, the complainent & his advocates do not turn up. This is amounting to mental harrasment of mr X. How can he request the court to either discharge the matter or prosecute the same as fast as possible?. The defamtion case is also pending against the complainent. Please advise.

Discharge is not possible after the charges have been framed. Face the trial or file a Criminal Writ Petition against the chargesheet, including on the ground of inordinate delay in the trial.
