Void agreement to sale?

Recently me and my 2 sisters signed a registered Agreement To Sale. The document did not mention anything about the 2 storeyed building that is inside the demarcated area (which was also supposed to be sold) and only talks about the land. It also had a clause saying that if required at the time of registration we can reduce the area from 2500 sq ft which was mentioned in the agreement. Also the owners around the 4 boundaries were wrongly mentioned.

For some reason we do not want to sale the plot and building now. Can we take a stand that the agreement was void?

If Your agreement is Registered agreement  to sale that can be canceled by way of application to the sub-regst. Office. You have to give the satisfactory reason there after the notice will sent to the other party and after the verification the agreement will be cancel.

Before that how you will prove that it is void agreement?

Assume that you agreement is void, have you informed to the sub-regst. Office?

This type of question will be arisen.

Dear Sir,

Thanks for your reply!

As per the Sale Agreement the Sale registration should be completed by June 15, 2016. Is it still require to inform Sub Registrar office since it will automatically expire. Otherwise, is there any time frame within which the Sub Registrar office has to be informed?

Please help.
