Vat notice from builder

Hi,

   I have a question regarding Mvat payment to builder in Maharashtra. In my flat purchase agreement its written that I should pay to the builder VAT amount if and when asked by him in future and builder now asked me to pay it.  I could not find any VAT payment receipt in demand letter so I demanded it and he failed to give me. Now I heard he is going to send  legal notice through lawyer.

   What kind of case builder can register in court against me? It must be civil case right? how much time will it get to start its trial in court?

YES IT WOULD BE A CIVIL CASE, BUT AT THIS MOMENT HE CANNOT RECOVER THE MVAT AGAINST YOU AS THE MATTER IS STILL PENDING IN THE SUPREME COURT.
