YOU want money?  File maintnance application both interim and permanent.  Both take time to get decided (minimum 1 year at least), after that your husband has to pay arrears, then if he dont pay, warrant issue, NBW jail going all that stuff.

 

If you go for MCD under 13 B, you get divorce in 6 months, but ask one time permanent alimony from husband if he is ready to give MCD ie mutual consent divorce, keep that money for sake of dotters and you. 

If he not ready for MCD, and wants to contest divorce, it may take 5-6 years to get decided, aur beech mein aapka maintenance application bhi decide hoga, aur if he is healthy male who is capable of earning money, then he will need to pay money as maintenance to you as well as your daughters.

Itna mat socho. Relax and think, and take step forward.

For DVC - case may be filed u/s 200 of Cr.P.C, mentioning DVC Act Secs. underwhich, what type of maintenance reqd. It requires counseling by Protection Officer of Dist.level. She can also seek maintenance u/s.125 & for childern to maintenance case can be filed under Maintenance of Childs & Adoptation Act. Ur.Advocate can guide u properly.

For Divorce,it is too early to file; I am afraid she may not get maintenance at this stage.

In any case, Court jurisdiction may have to be decided by SC (as TWO HCs are involved),if other party mopves in SC.

Any step taken may be decided thinking twice.

You have been given excelent advises and very good suggestions, of course all at free of cost but you seem either not to understand the experts' opinion or looking at more and more similar opinions from different lawyers of this forum by stretching this query unnecessarily without adding any value to your original and subseqquent queries. 

Hope you understand the situation and would proceed as advised, first make some efforts and then come back if you are struck some where.

I support the view of Mr.Kalaiselvan.The thread has sailed beyond the limitations,as even now the querist is not able to receive the apt advices of the legal experts.Going on extending the query will certainly deprive the querist the requisite solution,as it turns out into a debate when non legal member enter the foray just deviating from the original query.It is nothing but a lawyer performing an operation and a doctor arguing in the court of law.
