Urgent suggestions needed

Dear All,

I was working with an indian company since the last 8 months.I was brought to this company by my boss in the previous company who was hired by this company as a COO.

Due to some serious issues my boss had with the CMD of the company he resigned.The company in return blocked the email ids of my boss and me.

Therefore i also resigned 20 days back.

I have not been going to the company since then.I have the called and e-mailed the HR but there has been no response.I also spoke to the HOD he is saying to handover the laptop and documents and then everything will be done.The HR is not entertaining me.Also they have not paid me the July months salary till date which was due before i resigned.

I initially wrote in my resignation mail that i would serve 3 months notice period but now seeing their attitude and atmosphere there i do not want to serve it.I have also got a new job which i have to join a.s.a.p.I am ready to pay for 3 months notice.

 

Now i have the follwing questions-:

 

1. Can i get relieved by the company by paying 3 months salary now?

2.Further should i courier the laptop,documents i have to the company asking for reciept as going physically there to handover they won't provide me with reciepts and in courier i would have a proof that they have recived the laptop.

3.How should i handle the non receipt of relieving letter in the new co.?

 

Appreciate a quick response.

Yes you should get relieved by paying 3 months salary. I personally feel that you should go to the company and hand in your laptop and other documents and asked for a receipt that you have handed them in. The non receipt of the company relieving letter should not affect your new job since you have already told them that you were working for a particular company and that you will now be working for the new company.

Try to settle everything in person which is always good. You may be able to make quick decision regarding everything on the spot. There may be certain formalities left. Right now they are avoiding you because they know you are reluctant to come  yourself to settle your account and everything but later on they may file a complaint regarding you to the police that you have misappropriated the property of the company. They cant deny you the receipt of their property for a fact. Write them a mail regarding everything and take acknowledgement. Also speak to your HR personally and convey your intentions. You never they may just releive you without taking a penny.

May be your past boss is a cpable and helpful person. But you need not remain in his shadow all the time.

You have committed the same error that majority of the employs commit.

If your email id is required to perform your duty/work and it was blocked, you should have submitted a gentle communication thru Regd.Post or atleast from personal email id and asked what is your status in the company and what are the directions for you.

 

If you have resigned you could have mentioned that you are not allowed to perform your work and are left with NO other option.

If you have not been allowed to work and have been attending to office and your earned wages are not paid then you could have stated this fact as well.

The employee can lodge complaint the moment payment of earned wages is delayed even if by a day.

If you were asked to submit assets of the company it amounts to deemed termination.

If HR person or anyone else is not responding then you should have understood that it is to make to your resign and delay the payment of wages to FnF settlement and/or make you stop coming and declare you absconding or deny clean BGV/exit  and square off your dues.

 

You could have minuted and brought on record that you are not allowed in office/to work and you are at your address and on rolls.

If HR person not responding, you could have appraised HOD that asked to submit company’s property.

If you are apprehensive that acknowledgment of assets shall not be given keep your own counsel/union members/labor Inspector /witness with you.

 

Record (audio/visual/witnessed/minuted).

You could have sent your own FnF statement showing payables by you and by company and net that is due at anyone's end.

Thus you could have built some irrefutable written record.

 

The notice period of 90days may not be necessarily applicable even if it is inserted in appointment letter.

You may show all employment related docs to a very able counsel specializing in Labor/service matters.

Attempt to get relieving letter with good comments and acknowledgment of assets on the spot with comments that everything is in order.
