My grandfather died during the year 1986, leaving behind a land in the state of rajasthan whose patta was on the name of my grandfather, two months back my uncle builded a two floored house on it, but still the patta is on the name of my grandfather, and now there is fight between my uncle and father regarding the lawful owner.Sir/Madam the facts are as below, please help on the basis of these
1- There is no death certificate of my grandfather.
2- There is no legal heir certificate.
HOW go get these registered on the name of my uncle (has no children) & my father.

Since your grandfather had died intestate all his class one legal heirs have equal claim over the property. So first obtain a death certificate producing which you can obtain a legal heir certificate from the tahsildar office.then try to work out a family settlement
