I had a credit card from standard Charted Bank in 1995. In 1998 I had cancelled this card by cutting it into two pieces and sending it back to SCB. In this letter I had also mentioned that my address is changed and they should update my new address in their records. I have a copy of the courier slip and also a letter from SCB saying that they donot want to to loose a customer and someone will get in touch with me. Since then there was no communication from SCB. I had completely forgotton about this card and any balance on it. In the mean time around year 2000 I had applied for two more cards from SCB and was using them till 2007.
In may 2011 some agent called me and said I had a balance of 18L on the card I cancelled in 1998 and my name is in CIBIL list. In order to confirm their statement wrote to SCB customer support. They supported the agents claim and said I have pending amount. On my asking why was I not send the statement for so many years even though I was there customer till 2007, they simple said it was a case of disconnected record. After this I applied for my Cibil report. My Cibil score was 810. I did not wanted to go for any settlement since it may spoil my credit history so I refused settlement (which was around Rs 9000 and was verbally given).
All was well till April 2014. Again in may 2014 I got a call from some agent saying I have pending amount on my card. This amount has now become around 55L. Again they said my name in in CIBIL defaulter list but I refused to bow down to their threating calls. Last week I wanted to apply for a top up loan so I went for my CIBIL report. To my surpirse my CIBIL score has gone down to 640 and a new entry has been added to my report dated - 30 April 2014 - saying I have defaulted a CC from SCB and the amount is 55L and status is written-of.
Can someone please tell me
1. how can SCB update my CIBIL Report with CC information which is aroung 16 yrs old. Doesn't this comes under time barred credit law.
2. Do I have any legal rights in this scenario ?.
3. How and where can I file a complaint.
