Should paaa have index ii if it's already there in da and no purchase for extra area happened?

Respected Lawyers,

Our society went for redevelopment. There was a very detailed registered Development Agreement (DA) which is signed by developer and all members together that clearly has Index II document. I can also download it from IGR MH search site.

The same Index II clearly appears in my Individual Agreement for permanent alternate accommodation. Typically called as PAAA.

But the PAAA on its own does not have any new Index II of its own. I did not buy any extra area, so no financial transaction is done between me and builder for this agreement.

Is this normal that in such a case PAAA does not have any separate Index II?

Index II is generated only when an instrument is registered that attracts stamp duty and it reflects nature of transaction, consideration value (if any), stamp duty paid and the registration details. 

If no new conveyance / transfer of rights / consideration is involved, a fresh Index II is not mandatory.

The PAAA is a confirmatory / supplementary agreement, executed member-wise, refers back to the registered DA.  It Does not transfer ownership.

It Does not involve consideration when no additional area is purchased or no premium or price is paid by member.

Therefore, it is often either unregistered or a registered with nominal stamp duty or registered by referencing the DA’s Index II.  In such cases, a separate Index II is not generated.
