Self acquired property of my grand father

A self acquired property of my grand father who died leaving behind 4 daughters and 7 sons out of 7 sons 1 died before him. Son who died before my grand father has 4 childern who are not letting others in family to dispose the property. Can my father file an injunction suit against them? What can they do after my father files a suit? My grand father had never made any will.

It is believed that you are Hindu.

The self acquired property of deceased Hindu male shall be equally devided between ClassI legal heirs:

Mother, wife, sons, daughters.

The share of deceased son shall likewise devolve upon his ClassI legal heirs:  Mother, wife, sons, daughters.

 

Submit death certificate, legal heir certificate/affidavit as applicable at your location to revenue official e.g; patwaari to record inheritance.

 

Therafter the options are;

Amicable Registered family agreement and it shall remove any future litigation.

Partition deed

Partition suit

Sale of share of anyone to other Co-sharers thus without any alienation to the property.

 

Further you may approach a very able counsel specializing in revenue/family/property/civil matters with all dcos on record for a considered opinion.
