Sections for conversion of divorce petition to mutual divorc

We had an off court settlement and we have to pay alimony to the girl. We are asking the girls lawyer to agree to convert my divorce petition to mutual consent divorce for which the other lawyer is saying its not possible and we have to apply new mutual consent divorce petition after paying the alimony. Please help with sections under which my divorce petition can be converted to mutual consent divorce petition.

@ Querist,

No.her lawyer has not come out with clean hands. You will be in trap.Better you talk to your lawyer and ask him to draft a pettition citing the development of the case and mutual settlement s and give it to the concerned court where case was going. The judge will only tell you wether to withraw the contested divorce or he will grant leave on mutual divorce pettition.

No alimony you should provide to her before final decree.Better Prepare a MOU citing all settlelments and place infront of the court regarding MCD,if court not grants the conversion pettition.
