Dear friends,

Can a person file u/s 311 of CrPC, his medical report pertaining to impotency/potency

  • after arguments
  • dated 2 years back
  • by a private doctor
  • that too in DVC.

Dear Querist, 

311 applications are generally allowed if they are essential for the ends of justice. The Argument that the person is trying to fill up lacunae in his case - is a subsidiary consideration. However the final decision as to whether it may be allowed or not can't be said without knowing the genesis of dispute

I agree with Mr. Bharat Chugh's proposition about S.311 Cr.P.C.  But I wonder how the potency of husband related to the dispute involved in DV case?
