a case under sections 294(b),323, 326 was registered by the police. there was delay of 5 days in filing the F.I.R. the magistrate held that the delay was caused only due to the police officials and that the complaint should not suffer for the delay caused by the police and convict the accused. here the the complaint was give on the very next day of occurrence and the police officials gave a CSR and register the FIR after two days. plz give me citations in respect of this aspect that delay in filing the FIR is fatal to the prosecution case.
