Sir, My wife she took maternity leave from an ayurvedic private college from sep 2019 to feb 2020. Due to personal issues she couldn't work further so she resigned through mail and sent notice of resignation. Institution has 3 months notice period. But institute is saying they will relive after 3 months of notice period and also she has to pay 6 months salary which she has recieved. One more important thing, institute had gave only half of her salary during her maternity leave period. Please help by sharing supporting rules

Please help by sharing supporting rules

1. Since there is a notice period of 3 months in her letter of appointment, the college has right to release her after 3 months or in liue of notice pay.

2. There is no provisions to ask for salary of six months which was already paid to her.

3. She would be entitled to full maternity benefit. Hence, any deduction is illegal.

4. For supporting rules and provisions, it is better to consult a lawyer personally to get your query further settled.

Hope this satisfies you. Thanks.
