The first petitioner is in the 126 th position of the Rank list prepared by Pathanamthitta District PSC Office marked as exhibit P1. As per the letter No Dated exhibit P2.I am directed to appear before the NRHM Director on 08/11/2010.
On 08/11/2010 a counselling was conducted at the office of NRHM by DMO herself and I was appointed as Staff Nurse in PHC Kokkathode in the existing vaccancy with a salary of Rs.7480/-which is the salary of the staff nurse Grade 1.I got salary for the month of November on December 5,2010.
I had applied to the PSC for the post of staff nurse under the Health And Family Wealfare Department and not under the Health And Family Wealfare Society.It seems that there is no societies registered as Health And Family Welfare Society under Kerala Corporative societies or under Kerala Charitable societies Act.
We are advised on the existing vacancy, advise dtd 24.11.2010 For six candidates prooves it (Exhibit P5) & now also there were so much vacancies to be filled. As per Exhibit P4 There must minimum 1 post of staff nurse be on Each and every P.H.C's But in our district there were 14 phc s having no post of Staff Nurse. 1st petitioner is working at PHC Kokathodu There is no Post of Staff Nurse Yet. It makes Several Problems.Even a Tribal area, after all Having a Doctor also The Phc could not function properly. it makes a situation to work nonqualified staffs to do the works of staff nurses like pharmasist or jphn will do duty in the absense of the Post of Staff Nurse. it is a criminal offence punishable under Kerala Nurses and Midwives Act,1962. The Govt. it self is the culprit of this crime.Considering all these facts and circumstances we,the qualifed and eligible hands Considered by Govt.(department) and psc to do the dutys of the post, by giving the psc rank list to dept. to appoint as through an interview conducted by DMO hereself. Overall we have done duty For a basic salary of the post wich we have got, we are eligible for regularaization. hon'ble court considered these types circumstances several times .
On approaching the PSC,we noticed that PSC has given our adress to DMO to appoint us.So we humbly request that court may please regularise our service as we applied and regularise our salary as the post we are posted ie,Basic+D.A+Allowance+HRA with the effect of our joining date.
