registration required to sue job seekers

One job consultancy agency (proprietor ) offers jobs to job seekers and as a fee they charge half month salary of first month 's pay (to be paid after getting salary) . But many times, candidates willfully default in paying that . Agency wants to sue candidates getting job offer. Please tell what registration they should get in order to get legal status to sue candidates. Will MSME registration suffice? Or any other option??

a proprietorship company can always sue others for payment of debts. No need for any further registration
