Refund of money from builder

I come around a investment option in 2013 where i need to book a flat and builder will pay the EMI on the loan amount. Builder also promise that he will take the flat after 20 months and give appreciation of 50% on booking amount. We talk about flat buyback in between and their employee keeps asking to wait because of market slowdown. Now builder paid EMI for two and half year till november 2015 and stop paying after that. He also did not give TPT and an MOU ducument which we signed during agreement till now. however I get the document copy from bank but no MOU was deposited with the bank. Now no body answering the phone. I am based in Noida and builder is in chandigarh. I come to know that he has already sold that flat to someone. Please suggest what to be done next. should i go to conjumer forum or civil court. and which conjumer forum (chandigarh/noida/delhi) should be approached.

Legal notice to be sent at first. then file case in the civil courts or consumer courts at place where the builder office located.

What other document pertaining to the case about allotment, bank loan, or resale to other party, etc., you possess?
