Property purchased

Dear Sir,

Please note, I have purchased a property from a seller, the seller has sold his both SOP and Ancestral property and all his family members except one Daugter in law has not signed and her name also not included in the sale deed, since some issue with the her husband.

after the Khata has transferred in my name, I have gone for taking the possession, but in that position her daughter in law is staying and she is not allowing me to take the possession.

Now what I have to do, the seller is telling she is forceibly staying and also one FIR is also registered against her for trespassing the house.

Please advice me what I have to do now.

'Buyer Beware' is applicable while buying proeprty.

Daughter in law has no forced share in proeprty of father in law and husband.

If daughter in law is not owner of the property then her name can not be in sale deed.

Apparently you have not checked the property before purchase.

Usually it is mentioned in sale agreement/deed that no court case etc is on the property.

You may now show the mutation record that was place before registration ,link documents, sale agreement, sale deed to a very able counsel.

thanks for your advice, shall i give police complaint or shall i go for eviction order.

Please also advice now Khatha is also in my name, only possession has to be taken and also i have filed caveat.

You may now show the mutation record that was place before registration ,link documents, sale agreement, sale deed to a very able counsel, for considered opinion.
