Procedure for ipc 304a

Hi,

I am Rahul and I was charged under IPC 304A.

The amount for the deceased was settled by my third party insurance company. But my criminal case is still under trial. I have attended the court hearing for about 5 times now but the witness never appear and mycase is getting postponed indefinitely.

I want to know how long will this process take to complete? What if the witness doesn't turn up at all? Is there anything I can do to speed up the process as I have to travel aroad.

Please help.

accident cases will go around 2 years, if witness not come to give evidence than ask for warrant for witness.

Hello Rahul..

Ask your advocate to pray to the court for closure of evidence. As no witnesses have turned up so prosecution (police) has failed to prove the charge of sec.304A against you. So you will be acquitted ultimately if court permits closure of evidence of prosecution.
