I am planning to book a 2 BHK in Bangalore and need some guidance regarding the penthouse that the builder/owner are planning to construct. Currently the construction is as per approved plan (under construction). Builder is saying that he may construct additional as penthouses and get plan approval etc., but there will be no khata. His agreement with owner is pending.
1) Is it advisable to book in such a project?
2) If they dont agree to build penthouses now and we book, can the owner/builder still construct penthouses later infuture, after selling the main flats? say after 1 or 2 years? Can the flat owners (individual or association) stop such constrution?
3) If the flat owners cant stop such a construction and they build a penthouse, what happens to the undivided share of existing members?
Secondly, what is the difference between a penthouse rate (deviation) and a normal flat (approved)? Builder says he can easily sell his penthouses even if they are deviations.
