This is regarding a building in Gurgaon, New gold course extension road, sector 60X.
After 9-10 months of possession and attaining an occupation certificate, the builder has failed to provide 'residential elctrcity connection' . The residents are on a make shift 'constrcution electricity connection'.
The builder has accepted this problem but has failed to address the solution and the fix to the issue. We residents see this as illegal to have OC without an actual electrcity connection. We contacted the electric board and found that the builder yet has to pay the fee for connection initiation/secyrity deposit.. Also forgot to mention this 'Temporary construction Electricity connection' means 40% of times power cuts, fluctuations and poor disaster recovery for lifts during this time. Residents can;t sleep properly, read, study and can't live a regular life. This is causing health and safety issues as cell phones are not charged properly, appliances are at constant shor circuit possible dangers.
We sent a letter something like this to the builder: Your letter has still not answered one basic questions when will concient deposit the security deposit of 2.5cr with the Dakshin Haryana Bijli Vitran Nigam (DHVBN). Till the time it is not done we stand firm on our part of non payment. As we have deposited 1.24lakh interest on which @18% your rate is also acruable. Which we might not ask if you pay DHVBN for a 33kva connection the deposit of 2.5cr department has asked you for at earliest.
Is this something that can be taken to court? Please advise.
Also, is this civil , or criminal or Consumer court related? Any lawyers who can throw light on this. And also provide with a number along with a basic advice or two lines regarding this case.
