Need assistance for filing divorce

Im married for the past 6 yrs and im a working lady.After trying to adjust for these  many yrs we could realise that our heads dont match and we decided to part ways.

I work staying away from my husband.we used to meet quarterly either he used to come to my place or i used to go there.

My question is that,  Is there is any rule that to file for divorce mutually ,we have to stay away from each other, minimum for 1 yr  without meeting and then file papers for it

If the above answer is Yes,then after filing we have to again wait for 6 months to get another hearing.

In this case it will take min 2 yrs to get it.

Is there any way to expedite the process.

Your is a case of breakdown of marriage. You have very fairly stated to have tried to cope up with your husband but did not succeeded. Still I would advice you both try counselling sessions and give a last try.

 

Regarding your question - 'Mutual Divorce' is filed under Section 13.B of Hindu Marriage Act, 1955 and is stated below for your reference: -

 

(1)       Subject to the provision of this Act a petition for dissolution of marriage by a decree of divorce may be presented to the district court by both the parties to a marriage together,whether such marriage was solemnized before or after the commencement of Marriage Laws (Amendment) Act, 1976 (68 of 1976), on the ground that they have been living separately for a period of one year or more, that they have not been able to live together and that they have mutually agreed that the marriage should be dissolved.
(2)       On the  motion of both the parties made not earlier  than six months after  the date of presentation of the petition referred to in sub section (1) and not later than eighteen months after the said date, if the petition is not withdrawn in the meantime, the court shall, on being  satisfied, after hearing the parties and after making such inquiry as it thinks fit, that a marriage has  been solemnized and that the averments in the petition are true, pass a decree of divorce declaring the marriage to be dissolved with effect from the date of the decree.
 
 

Living seperately means two persons living in different homes and not under one roof. Cohabitation is in default not permitted. Any instance of cohabitation within this prescribed 1year would vitiate the seperation.


 
Hence you and your husband have to move court with a joint petition for Mutual Divorce. The court would send you two for mediation and may inquire about you two being living seperately. After this court shall give a dates so make effort for reconcilliation as it is duty bound to do so. However if you and your husband are not able to live together even after 6months of filing the petition then you have to move another application in the same petition that 6months have elapsed and you jointly plead to the court for a decree of divorce.

Thanks Saurabh for ur response.I will take it as per ur advise

I have still confusion for the seperation period  before the  first divorce appeal in the court.

1.As i said i stay far away from him for the past 4 yrs,but goes to his place on rare occasions for a day or two and then return back.Will this be an obstacle in filing the joint plea for the first time in the court as regards to the law mentioned (on the ground that they have been living separately for a period of one year or more,).U may have explained it properly ,but i got confused with the law language used.(Please  bear with me).

2.If mutually we proceed and file the Paper for divorce in court ,and though we are living seperately now,if after 6 months my husband dont turn up for to jointly apply for the decree of divorce.then whts the outcome.

1. I do not see staying for one of two days in a year under a same roof being a problem. Unless other party wants to make it a problem.

2.  If other party does not appear on second motion - divorce petition will go nowhere--- you can not get divorce on mutual consent ground.

In fact probem highlighted in point two above are  one of the major issues and one party drags other if they want to.

first be brave to take decision, then take first step which is mandatory to reach to destination.

go for first motion on mutual consent divorce as u said, which you can file

than dont see ur hubby for further six months

than go for second motion on mutual consent dirvorce

if you dont want to go for divorce in court then pls let us know......there is another way to get it.......which many of the of them know but dont apply........it is nor available in law books.......but it is used in very large scale.....
