Name change

sir, got married 7 yrs ago. she was using my name. now she has applied for post graduation. her UG certificates have her maiden name. got married in Kerala. working at Tamil Nadu for the last 13 years. PG planned in Tamil Nadu. 

bank account and PAN card are in my name.

1. can i use the marriage registration alone to change the name when applying for PG? will the university accept it? if not what can i do?

2. do i need a notary certificate or a gazette notification? any law stated on this?

3. if i need a gazette notification, do i do it in Kerala or in Tamil Nadu?

4. why do they have to make it so difficult? what can we do to make it simpler?

saw a format for medical registration in Pakistan Medical Council.

they have in the last page allowed for change of name and also specified on what basis they will do it!-on the basis of the nikah nama or affidavit.

can India not have mechanisms which are simple for the common person to follow without having to grease palms and unnecessary ambiguity?

and -if you do a search on google--some people have posted advertisements and phone numbers claiming to make it easy to change names!!!

Mr. John ,

First of all your approach to the problem especially comparing other country law to that of ours is  wrong and illegal.  Pakistan has many stricter laws which are not at all considered by Indian laws, can a Pakistani question his country law based on this ?  For change of name the procedure to be followed is to effect it through a gazette publication.  Now since you are residing in Tamilnadu for more than a decade, you can effect the change in TN Gazette itself.  However the gazette publication will not automatically confer you with the power to change your name in the educational certificates, you may have to apply to the concerned educational department to have it corrected based on the Gazette publication.  If the authorities insist a Court order to this effect, you have to file a declaration suit declaring your present name and apply for it with the judgment copy.  These checks are implemented to avoid impersonation/forgery and lot of other criminal manipulations, hence in order to be authentic, you have to follow the set of procedures meant for it, law has no excuse.

Sorry Sir. this is not a life or death issue and I did not mean to be disrespectful to the Law or the Lawyers of my nation!

but still my basic question is not settled.

millions of married families live in India. most of them change the wife's name. or would like to. 

is it not natural justice that what is commonplace need should have a solution which is accessible to the common man.

is there a law or statute which has declared regarding this? if  there is a need to clarify, who is to decide?

different lawyers on the net have different answers for the same question.

in the institution I am applying to for PG studies, the authorities have asked to use the maiden name. they are allowing her to work with my name based on the marriage certificate. then i saw the barrage of answers online. so this outburst...
